Welcome to Driften. These Terms & Conditions (“Terms”) govern your access to and use of the Driften website, products, services, and online store.
The website and Driften brand are operated by Happy Medium Wine Co, Inc., doing business as Driften (“Driften,” “we,” “us,” or “our”).
By accessing our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree to these Terms, please do not use our website or services.
1. Eligibility and Age Requirements
Driften offers both alcoholic and non-alcoholic wine products.
You must be 21 years of age or older to purchase alcoholic beverages from Driften.
By purchasing an alcoholic product, you represent and warrant that:
You are at least 21 years old;
The information you provide regarding your identity and age is accurate;
You are legally permitted to purchase and receive alcoholic beverages in your jurisdiction; and
You are purchasing the products for lawful personal use and not for unlawful resale.
We reserve the right to verify your age or identity at any time and to cancel or refuse an order if we cannot verify that you satisfy applicable age requirements.
Products marketed as non-alcoholic may contain trace amounts of alcohol. Please review the product label and product information before consumption.
2. Alcohol Sales
The sale and shipment of alcoholic beverages are subject to federal, state, and local laws.
Driften will only sell and ship alcoholic products to locations where such sales and shipments are legally permitted and where Driften or its applicable licensed partners are authorized to make such sales.
Product availability may therefore vary by state or location.
We reserve the right to:
Restrict sales to certain jurisdictions;
Limit quantities;
Require age verification;
Refuse or cancel orders;
Require additional information before fulfilling an order; or
Modify shipping or fulfillment methods to comply with applicable law.
An order confirmation does not necessarily constitute final acceptance of an order. We may cancel an order if fulfilling it would violate applicable law or regulatory requirements.
3. Alcohol Delivery and Adult Signature
Deliveries containing alcoholic beverages may require the signature of a person who is at least 21 years old.
The recipient may be required to present a valid government-issued photo identification showing proof of age.
Alcoholic beverages will not be delivered when the delivery provider cannot verify the recipient’s age or when delivery would otherwise violate applicable law.
Alcohol shipments generally cannot be left unattended.
You are responsible for providing a shipping address where an eligible adult can accept the shipment.
If an order is returned because delivery attempts were unsuccessful, an adult was unavailable to sign, age could not be verified, or an incorrect address was provided, additional shipping or handling charges may apply.
4. Responsible Consumption
Driften supports responsible consumption of alcoholic beverages.
Please enjoy responsibly.
Do not drink and drive. Alcohol should not be consumed by anyone under the legal drinking age or by anyone who should not consume alcohol for medical, legal, or other reasons.
Nothing on our website constitutes medical or health advice.
5. Orders
All orders are subject to acceptance and availability.
We reserve the right to refuse, limit, or cancel any order for any lawful reason, including:
Product availability;
Pricing or product-description errors;
Suspected fraud;
Age-verification issues;
Shipping restrictions;
Alcohol regulatory requirements;
Orders that appear intended for unauthorized resale; or
Other legal or compliance concerns.
If we cancel an order after payment has been processed, we will issue an appropriate refund.

Prices may change without notice.

7. Shipping
Shipping availability, rates, and delivery times depend on the products ordered, delivery location, applicable alcohol laws, and the carrier or fulfillment provider.
Estimated delivery dates are estimates only and are not guaranteed.
Driften is not responsible for delays caused by carriers, weather, natural disasters, regulatory restrictions, incorrect addresses, unsuccessful delivery attempts, or circumstances outside our reasonable control.
Additional restrictions may apply to alcoholic beverage shipments.
8. Returns, Refunds, and Damaged Products
Returns and refunds are subject to our posted Shipping & Returns Policy, which is incorporated into these Terms by reference.
Because alcoholic beverages are regulated products, returns may be restricted by applicable law.
If your order arrives damaged, incorrect, or otherwise materially defective, please contact us promptly with your order information and, where appropriate, photographs of the damaged shipment.
We will evaluate requests and provide a replacement, refund, credit, or other remedy where appropriate and permitted by law.
9. Wholesale Customers
Driften may sell products to approved retailers, distributors, wholesalers, hospitality businesses, and other commercial customers.
Wholesale purchases may be subject to additional terms, including:
Minimum order quantities;
Case-pack requirements;
Wholesale pricing;
Payment terms;
Freight charges;
Distributor arrangements;
Territory restrictions;
Resale requirements;
Alcohol licensing requirements;
Promotional allowances; and
Separate written agreements.
Wholesale customers purchasing alcoholic products represent and warrant that they possess all licenses, permits, registrations, and authorizations necessary to purchase, possess, distribute, or resell those products.
If separate wholesale terms or a written agreement conflict with these Terms, the applicable wholesale agreement will control with respect to that transaction.
10. Product Information
We attempt to accurately display and describe our products, including flavors, ingredients, packaging, alcohol content, nutritional information, photographs, and other characteristics.
However, actual products may differ slightly from photographs or descriptions displayed online.
Packaging, labels, formulations, vintages, ingredients, availability, and other product characteristics may change from time to time.
Always refer to the physical product label for the most current product information.
11. Non-Alcoholic Products
Certain Driften products are marketed as non-alcoholic or low/no alcohol.
A product described as “non-alcoholic” does not necessarily mean that it contains absolutely zero alcohol. Certain products may contain up to the amount of alcohol permitted for products labeled or marketed as non-alcoholic under applicable law.
Please review individual product labels for alcohol content.
12. Promotions and Discount Codes
Promotions, discount codes, free shipping offers, giveaways, and other offers may be subject to additional terms.
Unless otherwise stated:
Promotions cannot be combined;
Promotions have no cash value;
Promotions may be limited to certain products, customers, or locations;
Alcohol-related promotions remain subject to applicable law; and
Driften may modify or terminate promotions where permitted by law.
13. Website Accounts
You may have the option to create an account.
You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.
Please notify us promptly if you believe your account has been accessed without authorization.
We may suspend or terminate accounts that violate these Terms or are used for fraudulent, unlawful, or abusive activity.
14. Intellectual Property
The website and its content, including the Driften name, logos, trademarks, product names, packaging, graphics, photographs, videos, designs, text, copy, and other materials, are owned by or licensed to Happy Medium Wine Co, Inc. and are protected by applicable intellectual property laws.
You may use the website for your personal, non-commercial use.
You may not reproduce, distribute, modify, sell, license, publicly display, commercially exploit, or create derivative works from our website or content without our prior written permission.
Nothing in these Terms grants you ownership of any Driften intellectual property.
15. User Content
If you submit reviews, photographs, comments, testimonials, social media content, or other materials to us, you represent that you have the right to provide that content and that it does not violate the rights of another person.
Where permitted by law, you grant Driften a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, adapt, and publish content you voluntarily submit to us in connection with operating, promoting, and marketing Driften and our products.
16. Prohibited Uses
You may not use our website or services:

To purchase alcohol if you are under 21;
To misrepresent your identity or age;
To commit fraud;

TO THE FULLEST EXTENT PERMITTED BY LAW, HAPPY MEDIUM WINE CO, INC., DRIFTEN, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OUR WEBSITE OR SERVICES.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
